Regulatory Requirements/NPDES Permits

Federal and State legislation, and their subsequent regulatory requirements, form the basis for the changes in stormwater management programs in Florida in the last two decades. This legislation has expanded the focus of a City's drainage program to include floodplain regulation, water quality management and ecological preservation.

NPDES Permit

As part of the federal Clean Water Act, the U.S. Environmental Protection Agency regulates the operation of most municipal drainage systems (pipes, drains, ponds, canals, etc.) In addition, they also regulate all industrial activity with any potential to affect surface water quality. Included in the definition of industrial activities are any land disturbing activity or construction. The City of Fort Myers is required to operate a compliance inspection program to ensure that activities within the city do not negatively impact surface water quality.

All projects disturbing more than one acre of land are required to file a Notice of Intent (NOI) to operate under the statewide Generic Construction Permit. The NOI is filed with the Florida Department of Environmental Protection (FDEP) along with a fee and a copies of the NOI and the accompanying Stormwater Pollution Prevention Plan (SWP3) are required by the city.
